Under this program, family law cases in Winnipeg are automatically managed by the court to reduce unnecessary delay and expense by promoting early and fair settlements. A Family Division judge is assigned to the case, presides at the initial case conference with the parties and, if represented, their lawyers, and may remain available to help manage the case through further case conferences. Typically, a maximum of three case conferences may be held in a matter although further case conferences can be scheduled by a judge in extenuating circumstances. .

Family Division Case Management began with a pilot project in Winnipeg in November 1995. During the initial phase of the pilot project ten percent of Family Division cases were randomly selected to enter the case management process. After a 1998 evaluation of the pilot project found that case management was achieving its objectives, it was recommended that case management be expanded first to 20 percent of cases, and then to all Family Division cases. As of November 1, 2002, all Family Division cases in Winnipeg, with some exceptions, must enter the case management process.

A subsequent evaluation conducted in 2004 found that 100 percent case management successfully reduced the length of time to complete a family law case and reduced the number of contested motions requested and heard. The evaluation also found that fewer trials were held than on non-case managed files.

How to access this service
Case Management automatically applies to all Family Division Winnipeg cases (with some specific exceptions) opened on or after November 1, 2002.

The court will automatically schedule an initial case conference:

  • at the instance of a judge; or
  • at any time on the request of one or both of the parties in a family law matter.
