International Mediation

Province/Territory
Manitoba

Type of service
Mediation

Services offered
Family Mediation is a voluntary, facilitative process. Mediators assist parties to communicate, negotiate and cooperate and to focus on the needs of the child(ren) when resolving parenting disputes. The mediator is an impartial third party who provides an opportunity for participants to talk about important issues in a safe, confidential environment. Parties in mediation are encouraged to work collaboratively and avoid the adversarial court process. All agreements reached through mediation are outlined in a Mediated Agreement. Mediation agreements are not legally binding.

International mediation can occur if Family Conciliation Intake determines that it is appropriate and feasible. Family Conciliation is flexible around trying to address language issues. Also, Family Conciliation has participated in inter-country co-mediation involving a mediator in the other jurisdiction.

How to access this service
You can apply for mediation services directly, or the court, your lawyer, or another agency can refer you. You must take the For the Sake of the Children parent information program before you can go to mediation. For cases involving the Hague Convention on the Civil Aspects of International Child Abduction, Manitoba’s Central Authority may facilitate accessing international
mediation; in these situations consideration may be given to waiving the requirement to take the parent information program.
