T01 - APPLICATION: RELEASE OF INFORMATION UNDER PART I OF THE FAMILY ORDERS AND AGREEMENTS ENFORCEMENT ASSISTANCE ACT

Use this form to apply to obtain tracing information under Part I of the Family Orders and Agreements Enforcement Assistance Act (FOAEAA). It must be accompanied by an affidavit (form JUS528) and other supporting documents as set out in the FOAEAA.

Applications can be made by:

  • an authorized provincial or territorial maintenance enforcement program
  • an authorized police force investigating a child abduction under s. 282 or 283 of the Criminal Code
  • an authorized judge of a court or officer of the court, when requested by a spouse, parent or authorized individual or agency

T02 - AFFIDAVIT IN SUPPORT OF AN APPLICATION UNDER PART I OF THE FAMILY ORDERS AND AGREEMENTS ENFORCEMENT ASSISTANCE ACT

A completed form JUS 528 must be included with an application for tracing information under Part I of the Family Orders and Agreements Enforcement Assistance Act (form JUS 527).

I01 - APPLICATION: INTERCEPTION OF FEDERAL MONEYS UNDER PART II OF THE FAMILY ORDERS AND AGREEMENTS ENFORCEMENT ASSISTANCE ACT - JUS 578 (1997/01)

Use this form to apply to intercept federal moneys for family support purposes under Part II of the Family Orders and Agreements Enforcement Assistance Act.

Applications can be made by a court or provincial enforcement service.

Send completed applications, along with a garnishee summons, to the Family Orders and Agreements Enforcement Assistance Unit by registered mail or by any means allowed by provincial law.

Note: A garnishee summons must be served within 30 days of its issuance.

GAPDA JUS 339

Use this form to apply for garnishment under Part I of the Garnishment, Attachment and Pension Diversion Act.

Applications can be made by any creditor who has a judgment order against a person who receives a salary or remuneration from the federal government.

The completed application form, along with a garnishee summons and a copy of the judgment or order against the debtor, must be served to the appropriate address listed in the regulations. To serve these documents, send them by registered mail or by any means allowed by provincial law.

Note: A garnishee summons must be served within 30 days of its issuance.
