Provision

  38. (2) On an order under subsection (1) being made, the trustee shall assign and transfer to the creditor all his right, title and interest in the chose in action or subject-matter of the proceeding, including any document in support thereof.

Problem

In civil law, this meaning of the term "transporte" in the French version is specific to the common law and is no longer appropriate for the civil law. It is preferable to use the neutral term "transfère", which is valid for both systems.

Solution

In the French version, the term "transporte" is replaced by "transfère".

  38. (2) Lorsque cette ordonnance est rendue, le syndic cède et transfère au créancier tous ses droits, titres et intérêts sur les biens et droits qui font l'objet de ces procédures, y compris tout document à l'appui.
