Federal Real Property Act, S.C. 1991, c. 50 (title changed to Federal Real Property and Federal Immovables Act by the Federal Law-Civil Law Harmonization Act, No. 1, S.C. 2001, c. 4, s. 10)
- Provision
16. (1) ... the Governor in Council may ...
- (a) authorize the sale, lease or other disposition of any federal real property ....
- Problem
-
The terminology used here creates a disparity between linguistic versions. Aliénation, which includes
"sale"
/vente, is a narrower concept already included in the concept of"disposition"
found in the English version. In the French version, disposition is a broader concept that already includes the concept of aliénation. - Solution
-
In the English version, the term
"sale"
is withdrawn. In the French version, the terms vente and ou autre forme d'aliénation are replaced by the term disposition. - Harmonized Provision
16. (1) ... the Governor in Council may ...
- (a) authorize the disposition or lease of federal real property ...
