Manitoba Keewatinowi Okimakanak (MKO) operates a pre- and post-charge diversion program for ten of its thirty First Nation communities. The total population served is almost 65,000. This program marks a return to traditional ways of dealing with wrongdoing in First Nation communities.
The program, based on the First Nations Justice Strategy has two components: the magistrate’s court and the local justice organization. The magistrate’s court is the court of first appearance and it operates in Cree. It is made up of an Aboriginal magistrate and a Crown representative. These courts are less formal and deal with matters in a more culturally relevant manner and acts as a primary screening mechanism for all post charge referrals.
The second main component is the Justice Coordinator and Community Justice Workers (CJW). The CJWs develop and use culturally and community appropriate methods of dealing with cases diverted to the workers by the courts (post charge), the police and band constables (pre-charge) and the community. This strategy allows the communities to have input regarding their administration of Justice and responds to clearly identified concerns regarding access to and the quality of justice services in the respective First Nations communities.
